The parent who does not obtain custody of the child but remains a guardian is entitled to apply for access to the child.

The right of access is ultimately a right of the child. In considering an application for access the Court will ultimately look to the best interests of the child.

It can include the right to have the child stay overnight either occasionally, on alternate weekends or during school holidays and the right for parent and child to go on holidays together.

 

Grandparents can also apply to the court for access to their grandchildren.
