Guardianship in Ireland refers to the rights and duties of parents in relation to the upbringing of their children. It includes the duty to maintain and properly care for their children as well as taking part in the important decisions of a Child's life.

Married parents are automatically joint guardians of their children. Neither separation nor divorce changes this.

A father who is not married to the mother of his child does not have automatic guardianship rights. An unmarried father is entitled to apply to the Court to be appointed as a Guardian of his child.
