A Separation Agreement involves both parties to a marriage agreeing to terms on which they will live separately. The document is a legal contract which sets out the parties future rights and duties in relation to one another. The agreement is a legally binding contract setting out each party's rights and obligations to the other. It will usually contain terms with deal with the issues of the family home, succession rights, taxation, maintenance, child custody and access. When the document drawn up and signed by both parties is often called a "Deed of Separation". It can be made into a rule of court by application to the court. This would ensure that all the terms agreed upon regarding the children can be legally enforced where covered by appropriate legislation.
